Florida appeals injunction against new law banning drag shows

Florida filed a motion to initiate the appeal process

The office of the state attorney, Ashley Moody, filed a motion to initiate the appeal of the preliminary injunction.
The injunction was issued last week by federal judge Gregory Presnell.
For now, the law is blocked temporarily.
Florida bans drag shows and the new law prohibits minors from attending live shows featuring drag performers.
The state requested that the preliminary injunction be suspended

According to CBS Miami, on Wednesday, Moody’s office requested that the judge suspend the preliminary injunction.
The state of Florida requested that the law go into effect for all businesses, except for the plaintiff, the Hamburger Mary’s restaurant chain.
For now the injunction is in place while the appeal continues in the Eleventh Circuit Court of Appeals.
A restaurant chain sues after Florida bans drag shows

The Hamburger Mary’s restaurant chain has been presenting drag shows for families for years and invites children to participate.
The chain sued the state of Florida last month.
Hamburger Mary’s argued that the law was too broad.
They also said it infringed on the right to freedom of speech protected by the First Amendment.
The judge ruled the law banning drag shows was «vague» and «unconstitutional»

The judge determined that a drag show does not necessarily constitute an obscene performance.
Jeremy Redfern, press secretary for Florida Governor Ron DeSantis, a Republican, called the judge’s decision «completely misguided.»
