Voluntary Withdrawal of Lawsuit Against Genaro García Luna in the U.S.
Mexico has withdrawn the lawsuit against Genaro García Luna, while proceedings continue to recover assets linked to his corruption network.

The Financial Intelligence Unit (UIF) of Mexico’s Ministry of Finance and Public Credit (SHCP) announced on Tuesday the voluntary withdrawal of its lawsuit against former Security Secretary Genaro García Luna and his associates, currently in Miami, Florida.
The statement emphasized that both parties have requested the presiding judge to retain jurisdiction in the case, but only for the purpose of issuing a ruling based on the agreement reached.
However, the withdrawal of the lawsuit does not affect the pending sentence against García Luna and his family.
This is because such action would be requested following a conviction against him.

The trial, in which Mexico seeks to recover assets related to the former official’s corruption network, is being held in the courts of the Eleventh Judicial Circuit of Miami-Dade.
Judge Lisa Walsh has authorized the continuation of negotiations between the parties, even after the mandatory mediation phase, which ended on May 23, 2025.
Despite significant progress toward an agreement, it could not be formalized before the established deadline, according to reports from EFE and Infobae.
Therefore, the parties requested the voluntary withdrawal of the UIF lawsuit, with the option of presenting the agreement to Judge Walsh for enforcement.
Developments in the Genaro García Luna Case

If an agreement is not finalized within 30 days, Mexico will be allowed to refile the lawsuit in the same court to resume the trial.
Under Florida’s Civil Procedure Code, Mexico has the right to voluntarily withdraw its lawsuit at any time.
In this case, the parties have asked the judge to retain jurisdiction, allowing for a ruling to be issued if the agreement is finalized.
Separately, on May 22, 2025, a U.S. court issued a ruling against Genaro García Luna and his wife, Linda Cristina Pereyra.
Conclusion
Both must pay $2.488 billion to the Mexican state as part of their involvement in a bribery network related to public contract bidding.
The ruling followed a series of charges against Genaro García Luna, including drug trafficking, money laundering, and conspiracy, among others.
The former official, who was arrested in 2019, was convicted in 2023 for his ties to the Sinaloa Cartel.
