Harvard University and its prestigious Harvard Law Review are under scrutiny by the Trump administration over allegations of racial discrimination.
The U.S. Departments of Education and Health and Human Services announced the launch of a joint investigation.
The inquiry began following information suggesting that the law review’s membership and article selection policies may violate Title VI of the Civil Rights Act of 1964.
Both departments emphasized that Title VI prohibits recipients of federal financial assistance from discriminating based on race, color, or national origin.
Investigation Into Financial Ties and Editorial Selection at Harvard Law Review

The investigation will examine the relationship between Harvard and its law review, covering financial aspects, oversight mechanisms, and the processes for selecting articles and admitting members.
“The Harvard Law Review’s article selection process appears to choose winners and losers based on race, employing a spoils system in which race is as important—if not more so—than the merit of the article,” said Craig Trainor, Acting Assistant Secretary for Civil Rights at the Department of Education.
Trainor added bluntly, “No institution—regardless of its pedigree, prestige, or wealth—is above the law.”
The clash between the Trump administration and Harvard has escalated, particularly after threats to cut millions in federal funding to the university.
The Trump administration accuses Harvard of failing to address antisemitism on campus appropriately.
The university has responded by stating that it has taken action against antisemitism, but refuses to accept conditions that it argues infringe on its institutional independence and constitutional rights.
