Knowing how to react during a visit from ICE (Immigration and Customs Enforcement) can make the difference between protecting your rights or losing them due to lack of information.

Although immigration raids cause fear in many communities, U.S. law sets clear limits on when and how agents can enter private property.

The most important answer is this: ICE cannot enter your home without a judicial warrant signed by a judge, except in very limited circumstances.

Understanding the difference between a judicial warrant and an administrative order is key to avoiding abuses and staying safe.

Judicial vs. Administrative Orders: They Are Not the Same

Many people confuse the different types of orders ICE may show during an operation.

A judicial warrant is a document issued and signed by a federal judge after reviewing evidence and determining probable cause. This type of order may authorize entry into a residence or the arrest of a specific person.

In contrast, an administrative order—such as Form I-200 (warrant for arrest of an alien) or Form I-205 (warrant of removal)—is an internal ICE document, not signed by a judge.

Administrative orders only allow ICE to detain someone for a civil immigration violation; they do not grant legal authority to enter your home without your consent.

Your Home Is Your Most Protected Space

The Fourth Amendment of the U.S. Constitution protects your home from unreasonable searches and seizures by the government.

This means that unless ICE agents present a valid judicial warrant or you give them entry permission, they cannot legally enter your home.

A valid warrant must include your name, address, the purpose of the operation, and the signature of an independent judge. If the document lacks these elements, you are not required to open the door.

Immigration attorneys offer one clear recommendation: stay calm, don’t open the door, and ask to see the warrant under the door or through a window before granting entry.

Exceptions: When ICE Can Enter Your Home Without a Warrant

There are very specific situations in which ICE may act without a judicial warrant, known as “exigent circumstances.”

This can occur if a suspect enters a home while fleeing arrest, if there are signs of imminent danger inside (such as screams or calls for help), or if there is a risk of evidence of a serious crime being destroyed.

These exceptions are interpreted very narrowly and should not be used as an excuse to violate constitutional rights.

Outside of these exceptions, any entry without a judicial warrant or your consent may be considered a violation of the Fourth Amendment, noted Castel Blanco.

What to Do if ICE Knocks on Your Door During an Operation

If immigration agents show up at your home during an ICE raid, the main rule is to remain calm and not open the door.

You can communicate through the closed door and ask: “Do you have a judicial warrant?”

If they say yes, ask them to show it under the door or through a window. Carefully check that it has a judge’s signature and correct information.

If it is an administrative order, you can clearly state: “I do not consent to entry.” You are not required to let them in or sign documents that you do not understand.

You also have the right to remain silent and not provide false documents, as doing so can have serious consequences.

Your Rights in Public Spaces and Workplaces

In public places such as streets or parks, ICE can make arrests without a warrant if they have probable cause—meaning objective reasons to believe someone committed an immigration violation.

However, at your home or workplace, the rules change. There, consent or a judicial warrant is essential for a lawful action.

If you are detained, state that you want to speak with an attorney and remain silent until they arrive. You are not required to answer questions about your immigration status or citizenship, the Government of Mexico noted.

The Importance of Having an Immigration Attorney

Facing an encounter with ICE can be overwhelming, but you are not alone. An immigration attorney can assess your case, protect your rights, and represent you in court if deportation proceedings begin.

Never sign documents without fully understanding them. You could unintentionally give up important rights, such as the right to appear before a judge.
