Parole in place, an immigration program that allowed certain family members of U.S. citizens and military personnel to temporarily remain in the country, has been struck down by a federal judge in Texas.

The measure, introduced just months ago by the Biden administration, granted temporary legal status to spouses, parents, and children of U.S. citizens or service members.

According to the Santos Lloyd portal, this benefit helped applicants regularize their status without having to leave the country.

However, its suspension has caused uncertainty among thousands of immigrants who were awaiting approval.

The federal judge ruling against parole in place argued that the policy exceeded the executive authority of President Biden.

The decision followed a lawsuit filed by several states challenging its legality.

With this ruling, the program is indefinitely suspended, impacting thousands of immigrant families.

Many of them were seeking a legal pathway to obtain permanent residency without having to leave the United States, according to El Universo.

Government to Refund Money to Affected Applicants

According to Univision, the federal government announced that it will return approximately $55 million in the coming days.

This amount will be directed to the 94,000 migrants who paid the processing fee for parole in place but were unable to complete the process.

Each applicant will receive a refund of $580, according to immigration attorney Carlos M. García.

«The Biden administration has determined that the right thing to do is to return the money to those who were unable to proceed with their applications,» the expert explained.

Impact of the Parole in Place Suspension on the Immigrant Community

The cancellation of this program represents a significant setback for many families who saw parole in place as an opportunity to regularize their immigration status.

Pro-immigrant organizations have criticized the judicial decision and warned that eliminating this measure could increase the number of separated families.
