On the afternoon of January 1, just hours after celebrating the New Year,. Luz Ayala, 58, had a serious car accident.
It was 1:40 p.m. when a pedestrian tried to cross the busy E.E. Butler Parkway in Gainesville.
Suddenly, he was struck by a car and literally went flying through the air.

When paramedics arrived at the scene, they transported the injured man to a nearby hospital.
There, the he spent 23 days fighting for his life.

This car was driven by. Luz Ayala and she was arrested on May 15.
Police determined that Luz Ayala was at fault

The police investigation determined that Luz Ayala was at fault.
After analyzing all the evidence, they determined that Donald Lund was still in the pedestrian crossing when he was hit, not crossing in the wrong place as initially reported.
Therefore, Ayala was arrested and charged with second-degree vehicular homicide and failure to yield to a pedestrian, according to police records.
The good news for. Luz is that these charges are considered misdemeanors in Georgia, so she was able to post bail the same day.

Although she was released from Hall County jail within a few hours, that does not mean the chapter has been closed.
