1. Acceptance of Terms

Welcome to Mundo Now («we,» «us,» or «our»), a division of Conocer Digital Holdings, Inc. By accessing our website (www.mundonow.com), subscribing to our newsletters, accessing our content through social media channels, or using our rewards programs (collectively, the «Services»), you agree to be bound by these Terms of Service («Terms») and our Privacy Policy.

IMPORTANT NOTICE: THESE TERMS CONTAIN A MANDATORY ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 13) THAT REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES.

2. User Accounts and Access

Some features of our Services, including the BonBon Rewards Program, require you to create an account or log in. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.  

3. Newsletters and Third-Party Platforms

3.1 Beehiiv Integration: Our newsletters are delivered using Beehiiv technology. By subscribing, you acknowledge that your interaction with our emails is subject to these Terms. You may unsubscribe at any time using the link provided in the footer of every email.
3.2 Social Media: When you engage with our content via social media platforms (including through «smart links» or unlocks powered by BonBon), you agree to comply with both these Terms and the terms of service of the respective social media platform.  

4. User Content License (Grant of Rights)

By posting, uploading, displaying, or submitting any comments, suggestions, feedback, photos, or other content («User Content») to our Services (including via email or social media), you grant Mundo Now a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media now known or hereafter devised.  

  • You represent and warrant that you own or otherwise control all of the rights to the User Content that you submit and that the content is accurate and does not violate these Terms or cause injury to any person or entity.

5. Notice of Financial Incentive (BonBon Rewards)

We offer the BonBon Rewards Program, which provides you with access to exclusive content, ad-free experiences, gift cards, or other benefits («Rewards») in exchange for your enrollment and interaction with our Services.

  • Material Terms: To receive Rewards, you must provide certain personal information, including identifiers (such as your name and email address) and commercial information (such as your browsing history or interaction data). We may share this data with our rewards partner, BonBon Technologies, Inc., to administer the program.  
  • Value of Data: We have made a good-faith estimate that the value of your personal information is reasonably related to the value of the Rewards we provide to you. This estimate is based on the expense related to offering the Rewards and the revenue generated from personalized advertising and enhanced user engagement.
  • Withdrawal: Participation is voluntary. You may withdraw from the financial incentive at any time by deleting your account or contacting us at.

6. Intellectual Property

All content produced by Mundo Now, including text, graphics, logos, videos, and software, is the property of Mundo Now or its licensors and is protected by United States and international copyright laws. You may not reproduce, distribute, scrape, or create derivative works of our content without our express written permission.

7. Prohibited Conduct

You agree not to use the Services to:

  • Violate any applicable local, state, or federal law.
  • Upload viruses or malicious code.
  • Use automated scripts, bots, or scrapers to collect data from our Services without authorization.
  • Interfere with the operation of the BonBon Rewards program or attempt to fraudulently accrue rewards.  

8. Third-Party Services

Our Services may contain links to third-party websites or services, including Beehiiv (for newsletters) and BonBon (for identity and rewards). We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with these providers are solely between you and the third party.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED «AS IS» AND «AS AVAILABLE» WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MUNDO NOW, ITS AFFILIATES, OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO US IN THE PAST SIX (6) MONTHS; OR (B) ONE HUNDRED DOLLARS ($100.00 USD)..

11. Indemnification

You agree to defend, indemnify, and hold harmless Mundo Now and its partners (including BonBon Technologies and Beehiiv) from and against any claims, damages, costs, liabilities, and expenses (including attorneys’ fees) arising out of or related to your User Content, your violation of these Terms, or your violation of any rights of another.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.

13. Dispute Resolution and Arbitration

READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Arbitration shall be administered exclusively by JAMS and shall be conducted in Atlanta, Georgia consistent with the rules of JAMS in effect at the time the arbitration is commenced. The Parties waive all rights to have their disputes heard or decided by a jury or in a court trial and the right to pursue any class or collective action or representative claims against each other in court, arbitration, or any other proceeding. Any arbitral award determination shall be final and binding upon the Parties.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our Website. Your continued use of the Services constitutes acceptance of the modified Terms.
