The U.S. Citizenship and Immigration Services (USCIS) has announced that the Parole in Place program will return.

This benefit for spouses and stepchildren of U.S. citizens could resume on November 8, 2024, as stated by USCIS on its official website.

This follows a ruling by the Eastern District Court of Texas.

This program, known as Keeping Families Together, grants conditional parole in place to allow certain family members of citizens to stay in the country.

This allows them to process their residency status without having to leave the United States.

The judicial order, effective August 26, 2024, imposed a temporary suspension on the Parole in Place program, affecting new parole requests.

However, USCIS continues to accept Form I-131F applications and is scheduling biometric appointments for already submitted applications.

Individuals whose applications were approved before the August 26 suspension remain unaffected and retain their authorization.

The program’s suspension has created uncertainty for many families who rely on this measure to stay united.

On August 19, DHS (Department of Homeland Security) announced a detailed process and published eligibility requirements for the program in the Federal Register.

This process allows certain family members of U.S. citizens already in the country to apply for permanent residency status without separating from their families.

Parole in Place relies on DHS discretion to grant applicants temporary presence in the country for humanitarian reasons or significant public interest under the Immigration and Nationality Act.
